After Montana voters passed the legalization of recreational marijuana in the November 2020 election by a 57% to 43% margin, the state’s adult-use sales began on January 1, 2022. Reports from the Montana Department of Revenue showed over $1.5 million in marijuana sales on the first two days of recreational sales.
Although legal to possess and use in the entire state, not every county in Montana will have adult-use sales. In fact, only about half of Montana’s counties currently allow recreational sales. As per the law that was passed, only counties where a majority of residents voted in favor of weed legalization (referred to as “green counties”) in the 2020 election will have authorized recreational sales. Other counties would have to have a re-vote on the issue to change from a “red county” to a “green county”.
The transaction purchase limit for adults 21 and older in Montana is: up to one ounce of dry-leaf marijuana, 8 ounces of concentrate, and edibles with up to 800 total milligrams of THC.
